1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the AsiaXchange website, mobile applications, and money transfer and foreign exchange services (together, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms and by our Privacy Policy.
2. Eligibility
To use our Services, you must be at least 18 years old, legally resident in a jurisdiction where AsiaXchange operates, and able to complete our identity verification process. We may refuse service, suspend, or close an account where eligibility or verification requirements are not met.
3. Account Registration
You agree to provide accurate, current, and complete information when creating your account, and to keep this information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
4. Sending Money Through AsiaXchange
When you initiate a transfer, you authorize us to debit the applicable amount, apply the exchange rate and fees shown to you at the time of confirmation, and remit funds to your specified recipient through our banking and payout partners. You are responsible for ensuring recipient details are accurate; AsiaXchange is not liable for funds delivered to a recipient account you have provided incorrectly.
5. Exchange Rates and Fees
Exchange rates displayed across our website are indicative and may change until the point you confirm a transfer, at which point the rate is locked for that transaction. Applicable fees are disclosed before you confirm any transfer. We reserve the right to change our standard rates and fees at any time; changes will not affect transfers already confirmed.
6. Transfer Limits and Delays
Transfer limits may apply based on your verification level, transaction history, and the regulatory requirements of the relevant corridor. We may delay, hold, or decline a transfer where required for compliance, fraud prevention, or regulatory review, and will make reasonable efforts to notify you when this occurs.
7. Prohibited Use
You agree not to use our Services for any unlawful purpose, including money laundering, terrorist financing, fraud, or to send funds you are not legally entitled to send. We may report suspicious activity to relevant authorities as required by law.
8. Cancellations and Refunds
Transfers that have not yet been paid out to a recipient may be eligible for cancellation and refund, subject to any fees already incurred and the requirements of our payout partners. Once funds have been successfully paid out, they generally cannot be reversed.
9. Limitation of Liability
To the fullest extent permitted by law, AsiaXchange is not liable for indirect, incidental, or consequential damages arising from your use of our Services, except where such liability cannot be excluded by applicable law. Nothing in these Terms limits liability for fraud or for matters that cannot be limited under applicable regulation.
10. Suspension and Termination
We may suspend or terminate your account where we reasonably believe these Terms have been violated, where required by law or regulation, or to protect the security of our Services and other customers.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to you, and continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which AsiaXchange is licensed to operate, without regard to conflict of law principles, unless otherwise required by local regulation applicable to your use of the Services.
